[Watch] Enhle Mbali CONFIRMS customary marriage in old clip

A clip of an old interview in which Enhle Mbali Mlotshwa confirmed that she had married Black Coffee after a traditional wedding and lobola negotiations has resurfaced. In it, the actress also claimed that her DJ spouse later wanted a white wedding after his customary marriage.

This comes after the Grammy-award-winning hitmaker claimed he was never in a customary marriage with his ex-wife. His comments were made after the Constitutional Court made a landmark ruling which declared antenuptial contracts signed after these unions as invalid.

ENHLE MBALI SAYS BLACK COFFEE WANTED WHITE WEDDING

Speaking on the SABC show Real Talk, Enhle Mbali Mlotshwa discussed her weddings with Anele Mdoda.

The mother-of-two confirmed that she had married Black Coffee in a traditional wedding ceremony in 2011. However, she claimed she had prioritised having a family home over a white wedding celebration.

After building their dream home and being in a customary marriage, Enhle claimed that the couple then planned their white wedding.

She said, “We had the marriage going, it’s just the wedding. My dream [of a home] was more important than the wedding.”

When Anele asked whether Black Coffee was behind the white wedding, she replied, “Yes.”

WHAT IS A CUSTOMARY MARRIAGE?

According to South African law, customary or traditional weddings and marriages are negotiated, celebrated, and concluded according to indigenous customs.

Terms and conditions of a customary marriage include the following:

  • Both parties to the marriage must be above the age of eighteen years.
  • Both parties must consent to being married under customary law.
  • The marriage must be negotiated, celebrated, and entered into in accordance with customary law.

While lobola is not required for the validity of a customary marriage, its payment proves that the marriage was negotiated in accordance with custom.

As South Africa recognises customary marriages through the 1999 Customary Marriage Act, traditional unions – whether Zulu, Xhosa, or any other – are legally valid civil marriages, which are, by default, in community of property.

Under the act, the conclusion of lobola between a bride and groom’s families constitutes the beginning of a customary marriage.
